Welcome to Kisan Door Step\! These Terms of Use ("Terms") govern your access to and use of our website, mobile application, and grocery and vegetable delivery services (collectively, the "Platform").
Kisan Door Step is a grocery and vegetable delivery service based in Pune, Maharashtra, India. The technology platform powering Kisan Door Step is licensed and provided on a rental/SaaS basis by Enacute Solutions India Private Limited ("Enacute Solutions," "Licensor," "we," "our," or "us" in the context of software provision).
The commercial services, fulfillment, customer support, and operations are entirely managed by Kisan Door Step ("Company," "we," "our," or "us" in the context of delivery services).
By accessing, registering for, or using the Platform, you ("User," "Customer," or "You") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1. Eligibility
- You must be at least 18 years of age to register an account, place orders, or use our Platform.
- Our services are exclusively intended for users residing in Pune and surrounding regions, India. By using the Platform, you represent that you are located within our serviceable delivery zones.
2. Account Registration and Security
- To access certain features (such as placing orders), you must create an account by providing accurate and current information, including your name, email address, mobile number, and delivery address in Pune.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
3. Orders, Pricing, and Delivery
- Product Availability: All orders for vegetables, groceries, and perishables are subject to availability. We reserve the right to limit quantities or cancel items if stock is depleted.
- Pricing: Prices for items are listed on the Platform and are subject to change without notice. Applicable taxes and delivery fees (if any) will be displayed at checkout.
- Delivery: We strive to deliver your orders promptly to the address specified in Pune. Delivery times are estimates, and Kisan Door Step shall not be held liable for delays caused by traffic, weather, or unforeseen circumstances.
4. Payments
- We use third-party payment gateway partners (such as PayU, CCAvenue, and Jio-Payments) to process online transactions securely.
- By submitting payment details, you warrant that you are authorized to use the designated payment method. Kisan Door Step does not store complete credit card or UPI PIN data on its servers.
5. Intellectual Property and Technology Provision
- Platform Ownership: The underlying software, application architecture, design, source code, and trademarks of the Platform are owned by or licensed to Enacute Solutions India Private Limited. Enacute Solutions acts as an aggregator and rents/licenses this technology stack to Kisan Door Step to facilitate your grocery ordering experience.
- Limited License: Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial grocery shopping. You must not reverse engineer, copy, distribute, or modify any part of the Platform or its underlying technology provided by Enacute Solutions.
6. Limitation of Liability and Disclaimers
- Operational Liability (Kisan Door Step): Kisan Door Step is solely and exclusively responsible for the fulfillment of orders, delivery quality, customer service, facing the customer, and the resolution of all disputes related to the grocery products and services.
- No Privity of Contract with Enacute Solutions: You explicitly acknowledge and agree that your commercial transaction and contractual relationship is solely and exclusively with Kisan Door Step. Enacute Solutions India Private Limited acts strictly as a backend technology aggregator. There is no privity of contract between you (the User) and Enacute. You hereby waive any and all rights to bring any legal action, financial claims, or disputes against Enacute Solutions regarding the Platform, products, payments, or delivery services.
- To the maximum extent permitted by law, neither Enacute Solutions nor Kisan Door Step shall be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
8. Changes to Terms
We may modify these Terms at any time. Continued use of the Platform following any modifications constitutes your acceptance of the revised Terms.
